This course focuses on substance abuse, duty of care, and client protection. Attendees will learn the ethical and managerial duties required to protect clients, supervise impaired lawyers, and maintain firm integrity under the Rules of Professional Conduct. This course will provide an in-depth discussion about the Rules of Professional Conduct and what they say about attorney substance abuse and mental health issues in regards to the attorney, the attorney supervisor, and the attorney’s clients. The course will discuss the ethical duties to clients when attorney substance abuse or mental health impairs the attorney’s professional dealings with clients. The course will discuss ways to prevent harm to the clients and to prevent disciplinary exposure for the attorney. The course will explore the complex issues of dealing with an attorney with substance abuse and/or mental health issues within a law practice. Potential solutions are discussed during the program. It will examine some ways to identify if an attorney is having substance or mental health issues. This course will provide a base of skills, knowledge, and perspective regarding the substance abuse/mental health challenges of an attorney.
