This course provides an in-depth examination of the process and procedure of Probate Law following the death of a client. This course provides a fundamental overview of the process and procedure of the steps required to process the Estate Plan Documents. The Course will instruct Counsel on each step of the Administration of Decedent’s Intestate Estate (without Probate). This course provides practical guidance and a discussion on best practices regarding administration of a Decedents Intestate Estate. This course explores the complex issues and presents potential solutions to the legal and factual situations that arise. This course will provide a comprehensive overview of the laws and strategic considerations. This course will also provide a base of skills, knowledge and perspectives regarding the administrative steps of Probate Law. The course explores how to legally distribute a deceased person's real estate assets without going through probate court in Illinois. It emphasizes the importance of understanding the Illinois Title Insurance Act and the process of transferring property interests through a title company. Two hypothetical scenarios are presented, one without a will and one with a will, to illustrate the different procedures. The role of an attorney title agent is highlighted, emphasizing the financial benefits and the ability to manage the process more effectively. The presentation covers key aspects such as gathering necessary documents, conducting title searches, drafting affidavits of heirship and quitclaim deeds, and understanding the title insurance policy. It also touches on the importance of disclosing any business relationships with the title company to the clients.
